Increasingly, design firms are serving as subcontractors to design-build entities in the project delivery system. With the wrong contract for professional services, design professionals can face uninsured contractual liability exposures. And, with a design-build process where the design-builder provides a guaranteed maximum price to the client before the design has reached an elevated level of development, the design-builder’s cost recovery process against the design team can generate significant economic losses.
The AIA Contract Documents committee has refined the AIA design-build agreements and introduced a new progression design-build series of agreements. With progressive design-build, the design team, construction team, and client work together during the design process so that the project achieves the stated goals with only minimal changes to the true value-to-cost contractual arrangement.
